ShopHelper.io (“ShopHelper”, “WE” OR “US”) USER TERMS OF SERVICE
HOW OUR SERVICES WORK
ShopHelper offers a variety of support services for Shopify store owners. These support services are able to be purchased through www.ShopHelper.io. Tasks submitted by Users are worked on and completed by ShopHelper’s in-house Web Developers, Graphic Designers, and Project Managers. ShopHelper will need access to your Shopify admin. This is easily done by adding support@ShopHelper.io as a staff member.
After the User has purchased their desired support plan, the User is sent an email with instructions to add support@ShopHelper.io as a staff member and to submit their task to support@ShopHelper.io or use our online form. For quicker access you can install the Shophelper Shopify App. The User’s ShopHelper Project Manager will keep in touch with the User throughout the task completion process. ShopHelper will provide the User with a completed task, based on the User’s description of the task, and will then publish with the User’s permission and approval.
The User is then free to submit another task if they are on a monthly support plan, or have purchased another single task.
As noted above, Users must add their project manager as a staff member in their Shopify store. The User will need to enter this manually by adding firstname.lastname@example.org. ShopHelper will then receive an invite to become a staff member of your store. We will not need your login details for your Shopify store, as the invite provides us with access. We recommend that you remove us as a staff member once work has been completed. We will not share your login details other than to complete your project. Feel free to update your login details once the work has been completed.
At all times, you are responsible for having adequate security in place on your website. You agree to notify ShopHelper straight away of any unauthorised use, or suspected unauthorised use of your ShopHelper account or any other breach of security. We are not liable to any User for any loss or damage arising from User's failure to comply with the above requirements.
All Users are required to have a backup of their website and that all related data is completed, prior to initiating a Project. ShopHelper will create a backup of your theme with every project, however, ShopHelper will not be liable for any loss of data to any User.
PROJECT COMPLETION TIMES
Our single tasks are completed within 2 business days. Our Shopify support plan projects will be completed within 1 business day. If these time frames, for whatever reason (e.g. may be a bigger task than anticipated) will not be met, you will be notified with the reason why and a solution.
By using the Site, you represent, acknowledge and agree that you are at least 18 years of age. Further, you represent, acknowledge and agree that: (a) all registration information that you submit is truthful and accurate; (b) you will maintain the accuracy of such information and keep such information up-to-date, and (c) your use of the services offered through this Site do not violate any applicable law or regulation.
ShopHelper may terminate these Terms and your use of the Site without notice if ShopHelper, in its sole discretion, believes that you are under the age of 18, have provided inaccurate or incomplete registration information, or are otherwise ineligible to use our Site and services.
ShopHelper reserves the right to either suspend or terminate your access to the Site and account, reject your Project, and terminate these Terms. You are expressly agreeing that ShopHelper is permitted to bill you for the applicable fees, any applicable tax and any other charges you may incur in connection with your use of this Site and the fees will be billed to your credit card, PayPal or other payment method designated on your initial registration with this Site, and thereafter at regular intervals for the remainder of the term of these Terms. If you cancel your account at any time, you will not receive any refund. If you have a balance due on any account, you agree that ShopHelper may charge such unpaid fees to your credit card or otherwise bill you for such unpaid fees.
Please note, that for single task purchases, your credit remains valid for a period of 60 days starting the day of your purchase. Past this timeframe, your purchase becomes non-refundable.
REFUNDS AND CANCELLATIONS
The premise of our service is to offer both one-offs as well as on-going technical Shopify support, which is above the basic support offered by Shopify and Shopify theme and app partners. Please read our refund and cancellation policy. Delivery of the service stops the day the subscription is cancelled.
We ask that upon signing up to a monthly plan, you agree to either a 1 month or 3 month minimum term. If you do not think you will need the service for more than a month, it's best to consider other support options like our single tasks. The quality and value we are able to deliver are optimal when customers are with us a minimum of 3 months.
Our 14-day risk-free guarantee has your satisfaction in mind. Here are the 3 conditions of this guarantee:
1. Our service doesn’t meet your expectations after your first task completion
2. We’ve completed no more than 2 Shopify tasks for you
3. You haven’t used ShopHelper’s service within the first 14 days
If you cancel your subscription after the first 14 days and does not meet the three conditions above, a refund will not be provided.
ShopHelper offers a 100% satisfaction guarantee. Users who are not satisfied with the outcome of a Project (the "Outcome"), must notify ShopHelper at support@ShopHelper.io, within the timeframe set forth below. If ShopHelper is unable to provide User with a satisfactory Project Outcome, then it will fully refund User the Project fee, in accordance with this provision.
After the project has been marked as complete, the User then has 7 days to let ShopHelper know if they are not satisfied with the outcome. ShopHelper will not process a refund if the User has not expressed that they are not satisfied with the outcome in the above time frames.
Once you have notified us that you are not satisfied with the Project Outcome, ShopHelper will take steps to address your complaints about the Project Outcome, including asking a Developer to address your complaints regarding the Project Outcome. However, if after our attempts to address your complaints, you are still not satisfied with the Project Outcome, ShopHelper will issue you a full refund, and may, at its discretion, reverse or rollback, or direct the Developer to reverse or rollback, the work conducted pursuant to the Project and restore your website to its previous condition (before the Project was commenced).
By using the Site and/or the services provided on or through the Site, you consent to receive electronic communications from ShopHelper. These electronic communications may include notices about applicable fees and charges, transactional information and other information concerning or related to the Site and/or services provided on or through the Site. These electronic communications are part of your relationship with ShopHelper. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.
LINKS TO THIRD PARTY SITES
All levels of support plans offered by ShopHelper go through the same process. The process is outlined below:
- User purchases desired type of support
- User receives email with instructions ( submit task to support@ShopHelper.io)
- User approves ShopHelper access to their store
- ShopHelper works on the task and sends it to User
- ShopHelper publishes it to User’s store with permission and approval
- Depending on the support plan, User can submit a new task to be completed

- Single Tasks - 2 business days
- Monthly Support Plan Tasks - 1 business day
When using this Site and/or the services, you agree not to do the following:
Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Use offensive language. Discuss or incite illegal activity. Use explicit/obscene language or solicit/post sexually explicit images. Post anything that exploits children or minors or that depicts cruelty to animals. Post any copyrighted or trademarked materials without the express permission from the owner. Disseminate any unsolicited or unauthorised advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of such solicitation. Use any robot, spider, scraper or other automated means to access the Site. Take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Alter the opinions or comments posted by others on this Site. Take any action that may otherwise harm, disrupt or overburden the Site, or violate these Terms. This list of prohibitions provides examples and is not complete or exclusive. ShopHelper reserves the right to terminate your access to your account, your ability to post to this Site or use the services), with or without cause and with or without notice, for any reason or no reason, or for any action that ShopHelper determines is inappropriate or disruptive to this Site or services available through the Site, or to any User or Developer.
ShopHelper may report to law enforcement authorities any actions that may be illegal, and any reports it receives of such conduct. When legally required or at ShopHelper’s discretion, ShopHelper will cooperate with law enforcement agencies in any investigation of alleged illegal activity on this Site or on the Internet.
You agree to indemnify and hold ShopHelper and its officers, directors, employees, affiliates, agents, licensors, and business partners harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys’ fees and costs of defense) ShopHelper or any other indemnified party suffers in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party that your use of this Site or the use of this Site and the services available through the Site by any person using your ShopHelper username and/or password violates any applicable law or regulation, or the copyrights, trademark rights or other rights of any third party.
ShopHelper is a trademark of Zyber in New Zealand. Other trademarks, names and logos on this Site are the property of their respective owners. Unless otherwise specified in these Terms, all information and screens appearing on this Site, including documents, services, site design, text, graphics, logos, images and icons, as well as the arrangement thereof, are the sole property of ShopHelper.
LIMITATION OF LIABILITY
No ShopHelper party shall be liable to you for any damages resulting from your displaying, copying, or downloading any site materials or submissions to or from this site. In no event shall ShopHelper be liable to you for any indirect, extraordinary, exemplary, punitive, special, incidental, or consequential damages (including loss of data, revenue, profits, use or other economic advantages) however arising, even if ShopHelper knows there is a possibility of such damage.
If a ShopHelper party is found to be liable to you or any other person for any damage or loss arising out of or relating to these terms or your use of the site, or any content or services therein, the ShopHelper parties’ total cumulative liability shall in no event exceed the greater of: (a) the amount you paid ShopHelper for your use of the site, service and any content therein; or (b) the sum of one hundred (100) us dollars.
If you violate these Terms, ShopHelper may terminate and/or suspend your access to this Site without notice. ShopHelper will advise you of your inappropriate behaviour and to recommend a necessary corrective action. However, certain violations of these Terms, as determined by ShopHelper, may result in immediate termination of your access to this Site and the services available through the Site.
ShopHelper may also in its sole discretion and at any time discontinue providing the Site, the Site Materials and the services available through the Site, or any part thereof, with or without notice. You agree that any termination of your access to the Site, the Site Materials and the services available through the Site, under any provision of the Terms, may be effected without prior notice to you, and acknowledge and agree that ShopHelper may bar any further access to the Site, the Site Materials and the services available through the Site,. Further, you agree that ShopHelper shall not be liable to you or any third-party for any termination of access to the Site, the Site Materials and the services available through the Site.
LIMITATIONS & EXCLUSIONS
ShopHelper will not be liable in respect of any loss of profits, income, revenue, use, production or anticipated savings. ShopHelper will not be liable for any loss of business, contracts or commercial opportunities. ShopHelper will not be liable for any loss of or damage to goodwill or reputation. ShopHelper will not be liable in respect of any loss or corruption of any data, database or software.
If a Clause of the Agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, the other Clauses of the Agreement will continue in effect. If any unlawful and/or unenforceable Clause would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the Clause will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant Clause will be deemed to be deleted).
The Agreement is made for the benefit of the parties and is not intended to benefit any third party or be enforceable by any third party. The rights of the parties to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to the Agreement are not subject to the consent of any third party.
The Agreement will be governed by and construed in accordance with the laws of New Zealand, and the courts of New Zealand will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with the Agreement.
